- Phase In: Different aspects of the rule will be implemented at different times, depending on whether the facility is located in an urban or rural area:
- Waivers: While waivers are available, it’s uncertain whether providers will qualify. These waivers include:
- Funding: There’s no provision for additional staff funding, rendering the policy implementation challenging. CMS estimates the total cost of the rule at $43 billion over 10 years, while AHCA/NCAL estimates it to be over $6 billion per year. However, there are no mandates for Medicare, Medicaid, or other payors to increase payment rates to cover these requirements.
- Penalties: CMS will provide further details on compliance assessment and enforcement remedies after the publication of the final rule, ahead of each implementation date for the rule components.
